I was married in the Philippines, my wife refused the visa. My lawyer here tells me i must get divorce in America before i can marry again. If i get divorce here can i bring a filipia over on a fiance visa? Seeing as how i will marry in America and not the Philippines? Would i need anullment in Philippines?

My friend was married in philippines and live in europe. He was married for 3 or 4 years till she find somebody else. they divorsed and everything was ok here in europe. Till he go back to Philippines to married again and the same day he hear its not possible coz he did not yet have a annulment there. Mean this not bad but if you have money you can arrange everything there and he can still married the same day. He come back to europe and his wife start the papers and it take couple weeks and they send the papers here to process them. Thats was 2 years ago, untill now she is still in Philippines, the european goverment don,t allowed her to come here. So the best thing is to ask a annulment in philippines, there always a work arround but is not always the best idea.

I see so he divorced in Europe and still needed anullment to marry in Philippines. But how about if he wanted to bring her to Europe on a fiance visa? That way he would not be marrying her in the Philippines and he already has a divorce in Europe. So should'nt this be legal?

Your lawyer is right. US doesn't really care about most other countries marriage laws unless there is an agreement in place. So in theory, if your girl got the fiance visa and you married in the US it should go through without problems. The only thing I can see being an issue is if the embassy checks with the local Philippine govt and checks your marriage status which would still showed you married under Philippine law. Yet, I dont see that happening as long as you show the divorce paper work for your US marriage.
